Terms of Service

These Terms of Service ("Terms") govern your access to and use of everstead.llc (the "Site") and any digital products or software services (collectively, the "Services") offered by Everstead LLC, a New Mexico limited liability company ("we," "us," "our"). By accessing the Site or purchasing any Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old to use our Services. By using the Site, you represent that you meet this requirement.

2. Our Services

Everstead LLC provides digital products and software (including, where applicable, subscription-based access). Digital products and software are licensed, not sold, unless otherwise stated. Upon purchase, you receive a limited, non-exclusive, non-transferable license to use the product for your personal or internal business purposes, subject to any specific license terms provided at purchase or within the product itself.

3. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@everstead.llc of any unauthorized use.

4. Payments

  • All prices are listed in USD unless stated otherwise.
  • Payments are processed through third-party payment processors, including PayPal, Stripe, Payoneer, and other global payment gateways. We do not store full payment card or account details.
  • You agree to provide accurate and complete billing information.
  • For subscription-based products, charges recur automatically at the interval disclosed at signup until you cancel.
  • Taxes, duties, and currency conversion fees (where applicable) are your responsibility unless stated otherwise.

5. Subscriptions and Cancellation

  • You may cancel a subscription at any time through your account or by contacting us.
  • Cancellation stops future billing but does not retroactively refund the current billing period, except as described in our Refund Policy or required by law.

7. Intellectual Property

All content on the Site — including text, graphics, logos, software, and underlying code — is owned by or licensed to Everstead LLC and protected by intellectual property laws. You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from our products except as expressly permitted by your license or applicable law.

8. User Conduct

You agree not to:

  • Use the Site or Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Interfere with or disrupt the Site's or Services' functionality
  • Reverse-engineer, decompile, or resell any digital product/software except as permitted by your license
  • Misrepresent your identity or affiliation

10. Disclaimers

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERSTEAD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Everstead LLC, its members, officers, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in New Mexico, unless otherwise required by applicable consumer protection law in your jurisdiction.

14. International Users

Our Services are available worldwide. If you access the Site from outside the United States, you are responsible for compliance with local laws. Certain statutory consumer protections in your jurisdiction may apply and cannot be waived by these Terms.

15. Termination

We may suspend or terminate your access to the Site or Services at our discretion, including for violation of these Terms, without prior notice.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Site after changes constitutes acceptance.
